Written by epidemiologists, ethicists and legal scholars, this book provides an in-depth account of the moral problems that often confront epidemiologists, including both theoretical and practical issues. The first edition has sold almost three thousand copies since it was published in 1996. This edition is fully revised and includes three new chapters: Ethical Issues in Public Health Practice, Ethical Issues in Genetic Epidemiology, and Ethical Issues in International Health Research and Epidemiology. These chapters collectively address important developments of the past (...) decade. Three chapters from the first edition have also been reorganized: Ethicall Optimized Study Deisgns in Epidemiology, Ethical Issues in Epidemiologic Research with Children, and The Ethics of Epidemiologic Research with Older Populations. Although informed consent is important in clinical research, questions persist regarding when it is necessary, what it requires, and how it should be obtained. The standard view in research ethics is that the function of informed consent is to respect individual autonomy. However, consent processes are multidimensional and serve other ethical functions as well. These functions deserve particular attention when barriers to consent exist. We argue that consent serves seven ethically important and conceptually distinct functions. The first four functions pertain (...) principally to individual participants: (1) providing transparency; (2) allowing control and authorization; (3) promoting concordance with participants' values; and (4) protecting and promoting welfare interests. Three other functions are systemic or policy focused: (5) promoting trust; (6) satisfying regulatory requirements; and (7) promoting integrity in research. Reframing consent around these functions can guide approaches to consent that are context sensitive and that maximize achievable goals. (shrink)

We evaluate here the performance of four models of cross-situational word learning: two global models, which extract and retain multiple referential alternatives from each word occurrence; and two local models, which extract just a single referent from each occurrence. One of these local models, dubbed Pursuit, uses an associative learning mechanism to estimate word-referent probability but pursues and tests the best referent-meaning at any given time. Pursuit is found to perform as well as global models under many conditions extracted from (...) naturalistic corpora of parent-child interactions, even though the model maintains far less information than global models. Moreover, Pursuit is found to best capture human experimental findings from several relevant cross-situational word-learning experiments, including those of Yu and Smith (), the paradigm example of a finding believed to support fully global cross-situational models. Implications and limitations of these results are discussed, most notably that the model characterizes only the earliest stages of word learning, when reliance on the co-occurring referent world is at its greatest. We propose a causal model theory to explain asymmetries in judgments of the intentionality of a foreseen side-effect that is either negative or positive (Knobe, 2003). The theory is implemented as a Bayesian network relating types of mental states, actions, and consequences that integrates previous hypotheses. It appeals to two inferential routes to judgment about the intentionality of someone else's action: bottom-up from action to desire and top-down from character and disposition. Support for the theory comes from three experiments that (...) test the prediction that bottom-up inference should occur only when the actor's primary objective is known. The model fits intentionality judgments reasonably well with no free parameters. (shrink)

Neuromarketing is an emerging field in which academic and industry research scientists employ neuroscience techniques to study marketing practices and consumer behavior. The use of neuroscience techniques, it is argued, facilitates a more direct understanding of how brain states and other physiological mechanisms are related to consumer behavior and decision making. Herein, we will articulate common ethical concerns with neuromarketing as currently practiced, focusing on the potential risks to consumers and the ethical decisions faced by companies. We argue that the (...) most frequently raised concerns—threats to consumer autonomy, privacy, and control—do not rise to meaningful ethical issues given the current capabilities and implementation of neuromarketing research. But, we identify how potentially serious ethical issues may emerge from neuromarketing research practices in industry, which are largely proprietary and opaque. We identify steps that can mitigate associated ethical risks and thus reduce the threats to consumers. We conclude that neuromarketing has clear potential for positive impact on society and consumers, a fact rarely considered in the discussion on the ethics of neuromarketing. (shrink)

This paper provides a game-theoretic analysis of contrastive focus, extending insights from recent work on the role of noisy communication in prosodic accent placement to account for focus within sentences, sub-sentential phrases and words. The shared insight behind these models is that languages with prosodic focus marking assign prosodic prominence only within elements which constitute material critical for successful interpretation. We first take care to distinguish the information-structural notion of focus from an ontologically distinct notion of givenness marking, and then (...) outline the core properties of focus. We then introduce a signaling game between a speaker and hearer in which the goal is to transmit semantic content with the smallest signal possible. We apply the Iterated Best Response method of Franke to find equilibrium strategies in this game, where a unique equilibrium strategy in this case picks out the “critical information” of an utterance, which by hypothesis constitutes its focus. We show that iterating this game at different syntactic levels of a sentence makes correct predictions about the role of contrast in determining stress within words and phrases, and can be extended to account for association and second occurrence focus effects. Mimetic theory draws support from diverse disciplines in the humanities and social sciences. But arguably Girard would have even more influence if his theory had stronger life data, and one field well positioned to provide such input is psychology. Girard distinguished his thinking from Freud, while critiquing the psychoanalytic tradition more generally, in Book III of Things Hidden since the Foundation of the World1—a work taking the form of an extended dialogue with two psychiatrists. One of these, Jean-Michel Oughourlian, has (...) begun to develop the Girard-inspired practice of "interdividual psychology."2 In Girard's own hands, albeit to a limited degree, mimetic theory has been applied to mental health issues.3... The shift away from paternalistic decision-making and toward patient-centered, shared decision-making has stemmed from the recognition that in order to practice medicine ethically, health care professionals must take seriously the values and preferences of their patients. At the same time, there is growing recognition that minor and seemingly irrelevant features of how choices are presented can substantially influence the decisions people make. Behavioral economists have identified striking ways in which trivial differences in the presentation of options can powerfully and predictably (...) affect people's choices. Choice-affecting features of the decision environment that do not restrict the range of choices or significantly alter the incentives have come to be known as “nudges.” Although some have criticized conscious efforts to influence choice, we believe that clinical nudges may often be morally justified. The most straightforward justification for nudge interventions is that they help people bypass their cognitive limitations—for example, the tendency to choose the first option presented even when that option is not the best for them—thereby allowing people to make choices that best align with their rational preferences or deeply held values. However, we argue that this justification is problematic. We argue that, if physicians wish to use nudges to shape their patients’ choices, the justification for doing so must appeal to an ethical and professional standard, not to patients’ preferences. We demonstrate how a standard with which clinicians and bioethicists already are quite familiar—the best-interest standard—offers a robust justification for the use of nudges. (shrink)

This collection of original essays explores the connections between the philosophies of Alfred North Whitehead and the classical American pragmatists.

Access to communication is critical for individuals with late-stage amyotrophic lateral sclerosis and minimal volitional movement, but they sometimes present with concomitant visual or ocular motility impairments that affect their performance with eye tracking or visual brain-computer interface systems. In this study, we explored the use of modified eye tracking and steady state visual evoked potential BCI, in combination with the Shuffle Speller typing interface, for this population. Two participants with late-stage ALS, visual impairments, and minimal volitional movement completed a (...) single-case experimental research design comparing copy-spelling performance with three different typing systems: commercially available eye tracking communication software, Shuffle Speller with modified eye tracking, and Shuffle Speller with SSVEP BCI. Participant 1 was unable to type any correct characters with the commercial system, but achieved accuracies of up to 50% with Shuffle Speller eye tracking and 89% with Shuffle Speller BCI. Participant 2 also had higher maximum accuracies with Shuffle Speller, typing with up to 63% accuracy with eye tracking and 100% accuracy with BCI. However, participants’ typing accuracy for both Shuffle Speller conditions was highly variable, particularly in the BCI condition. Both the Shuffle Speller interface and SSVEP BCI input show promise for improving typing performance for people with late-stage ALS. Further development of innovative BCI systems for this population is needed. (shrink)

This article argues that assessment is a central feature of teaching, particularly as a means to determine whether what has been taught has been learnt. However, I take issue with the current trend in education which places a significant amount of emphasis upon large-scale public testing, which in turn has exacerbated the ‘teaching-to-the-test’ syndrome, not to mention distorting teaching decisions that are detrimental to the overall development of student knowledge and understanding. Part of the problem with assessment in education seems (...) to revolve around the nature of knowledge and how best to assess human knowledge and understanding. Although much philosophical uncertainty and disagreement exists surrounding the nature of knowledge, I argue that coming to know something is a sine qua non of any education. In saying this, I highlight the limits of assessment by demonstrating how certain activities are resistant to large-scale public testing because they are not easily reducible to facts which can be tested for, or at least in the same way as propositional forms of knowledge. Consequently, my argument is a philosophical one to the effect that assessment, particularly large-scale public testing is incapable of assessing all forms of learning, or even the quality of student understanding because the instruments available are both too blunt and tend to capture a certain kind of knowledge that privileges theory over practice, and mental skills over physical skills. In the conclusion to this multi-part article I first review the discussions carried out around the six essential questions in psychiatric diagnosis – the position taken by Allen Frances on each question, the commentaries on the respective question along with Frances’ responses to the commentaries, and my own view of the multiple discussions. In this review I emphasize that the core question is the first – what is the nature of psychiatric illness – and that in some manner all further (...) questions follow from the first. Following this review I attempt to move the discussion forward, addressing the first question from the perspectives of natural kind analysis and complexity analysis. This reflection leads toward a view of psychiatric disorders – and future nosologies – as far more complex and uncertain than we have imagined. (shrink)

We show that this class is first-order definable over the class of finite directed graphs and that this class admits a first-order definable global linear order. We apply this last result to show that FO = FO.

In face of the multiple controversies surrounding the DSM process in general and the development of DSM-5 in particular, we have organized a discussion around what we consider six essential questions in further work on the DSM. The six questions involve: 1) the nature of a mental disorder; 2) the definition of mental disorder; 3) the issue of whether, in the current state of psychiatric science, DSM-5 should assume a cautious, conservative posture or an assertive, transformative posture; 4) the role (...) of pragmatic considerations in the construction of DSM-5; 5) the issue of utility of the DSM - whether DSM-III and IV have been designed more for clinicians or researchers, and how this conflict should be dealt with in the new manual; and 6) the possibility and advisability, given all the problems with DSM-III and IV, of designing a different diagnostic system. Part I of this article will take up the first two questions. With the first question, invited commentators express a range of opinion regarding the nature of psychiatric disorders, loosely divided into a realist position that the diagnostic categories represent real diseases that we can accurately name and know with our perceptual abilities, a middle, nominalist position that psychiatric disorders do exist in the real world but that our diagnostic categories are constructs that may or may not accurately represent the disorders out there, and finally a purely constructivist position that the diagnostic categories are simply constructs with no evidence of psychiatric disorders in the real world. The second question again offers a range of opinion as to how we should define a mental or psychiatric disorder, including the possibility that we should not try to formulate a definition. The general introduction, as well as the introductions and conclusions for the specific questions, are written by James Phillips, and the responses to commentaries are written by Allen Frances. Morrow (Steubenville, OH: Emmaus Academic, 2020), 312 pp.Almost anyone who has suffered through a course in biblical studies at a secular (or, increasingly so, Christian) university, read a book, or heard a (...) lecture from one of its scholarly progenies is acquainted with the litany of hermeneutical absolutes. Among the factum historicum are the following certainties: the Enlightenment rescued the Bible from the Dark Ages; the Old Testament was shaped out of the mythical clay of Hellenism; Israel's priesthood was a lamentable development that hijacked an earlier, socially oriented love-of-neighbor religion, replacing it with its bloodthirsty, sacrificial cult; the Documentary Hypothesis is not merely a theory, but the scientific truth of how the Pentateuch emerged; one must separate the Jesus of history from the Christ of faith; Peter and Paul clashed over their dueling Christianities; and above all, historical criticism is the only reliable lens by which the Bible is to be studied.In Modern Biblical Criticism as a Tool of Statecraft (1700–1900), Hahn and Morrow expose such positivisms as the outflow of Europe's secularized universities over these centuries. Not only did politically motivated institutions seek to diminish the theological truths of Scripture (and sadly, were often successful at it), but they eventually repurposed the Bible as "a work of historical fiction," such that the Sacred Page was "to be studied like other ancient myths and fairy tales; it is one fairy tale among many" (24). The authors present a thoroughly researched and meticulously detailed study of the period, and throughout the book amply demonstrate that the aforementioned tropes (and numerous others), no matter how often or how confidently recited, are merely one slant on "the story of biblical criticism" in the modern age.Taking their lead from the lead of Pope Benedict XVI, Hahn and Morrow provide a much-needed critique of historical biblical exegesis and its "appearance of quasi-scientific certainty."1 These salient words of the biblical-theologian Pope, articulated in a variety of contexts (e.g., Verbum Domini), provide the jumping-off point for this robust three-hundred-page voyage. And it is a journey through a divided and secularized Europe, with notable stops in England, France, and above all, Germany. This "divided" Europe, the authors explain, was not a result of the Protestant [End Page 985] Reformation, nor of the so-called "war of religions" that sprang from it—no. The divisions run much deeper still. Drawing upon Andrew Jones's important Before Church and State, Hahn and Morrow rightly lament the societal competition that developed within late medieval Christendom between church and state.2Building upon Jones's work, the authors rightly stress that there indeed existed "a unified medieval worldview wherein what we might think of as temporal authorities and spiritual authorities were united in a single purpose—the extension of the kingdom of God—and this was the background that unified Christendom" (3). As Jones point out, this earlier period of European history "was a world not of the religious and the secular, but of the New Testament and the Old, of virtue and vice, grace and law.... It was an integral vision which included all of societal reality."3 Sadly, the reality of "sacramental kingdoms," in which there lived a reciprocal respect and vision of unity between throne and alter, was torn asunder long before the 1700s, the time at which the present volume commences. Over time, this formerly unified European world gave way to the very complicated, deeply skeptical, and highly politicized world of nation-states. And biblical criticism (along with many other worthy and creative endeavors), became deeply mired in "statecraft."Here, it is worth mentioning that the book should be approached as the rightful heir to an earlier volume (which involved one of its authors, Hahn), Politicizing the Bible.4 While Modern Biblical Criticism may be intelligently read upon its own merits, the reader would do well to pick up the earlier... Sorry that he is no longer here to read it, I consider in this paper Scott Cameron’s discussion of my views questioning the value of the concept of “nature” for environmental philosophy. Scott had suggested, based on arguments from hermeneutics, that although we never have access to a nature independent of our interpretations of it, still the existence of such a nature is necessarily presupposed by all such interpretations. I claim in response that if we replace the (idealist) (...) notion of interpretation by the (materialist) one of practice, that presupposition is no longer necessary: the independence required is built into the notion of practice itself, and need not be seen as a characteristic of the world “outside” of us. In “Molinism, Meticulous Providence, and Luck,” Steven Cowan argues that the doctrine of meticulous providence creates a damaging dilemma for Molinists. I argue that Molinists can overcome this dilemma without giving up the doctrine of meticulous providence.

In claiming that 'nature speaks', authors such as Scott Friskics and David Abram implicitly agree that language use is linked to moral considerability, adding only that we need to extend our conception of language to see that non-humans too use it. I argue that the ethical significance of language use derives from its role in dialogue, in which speakers make truth-claims, question and potentially criticise the claims of others, and provide justifications for the claims they raise themselves. Non-human entities (...) (as a contingent matter) seem not to engage in dialogue in this sense, and none of the examples Friskics and Abram offer suggest that they do. Thus the conception of language such authors employ is too weak to support the ethical conclusions they implicitly wish to defend. (shrink)

Here the emphasis is on a group of writers and thinkers that have embraced, each in his own way, such a concept only to have been misunderstood or ignored by their later readers and interpreters and thus to have been disregarded or held to be irrelevant in the present academic climate. Indeed, for many the idea that the physical world can act upon the mind (...) at all is a complete mystery on Descartes' principles, not least because the difference between the spatial and divisible nature of body and the non-spatial and indivisible nature of mind seems to preclude the possibility of body-mind contact or of a mechanism for such contact.1 Despite this, however, Descartes repeatedly affirms that body and mind interact causally. He claims that the fact of their disparate natures poses no special difficulty, and he even affirms that the mind and body can form a union (in the case of the human being).2In this paper I wish to examine two issues pertaining to the body-mind relation in Descartes' philosophy. First, I ask whether Descartes advances body-mind occasionalism: is there evidence in his writings of the view that bodies are not genuine causes of sensations, but are mere 'occasions' for God's production of sensations? Recently, it has been urged that Descartes begins his career as a body-mind causal interactionist, but perhaps ends as an occasionalist.3 [End Page 503] In Section 1 of what follows I argue against this. I attempt to show both that Descartes never strays from the body-mind interactionism which he is generally thought to espouse, and that he would undermine his proof of the material world if he did. The second issue I deal with concerns a position closely related to occasionalism which Steven Nadler has recently identified as body-mind "occasional causation."4 In Section 2 of the following I provide an interpretation of occasional causation as it appears in Descartes' reply to Regius in the Comments on a Certain Broadsheet. I argue that Descartes' occasional causation amounts to a form of interactionism which I term "inefficacious body-mind transmissionism." 1. Does Descartes Espouse Body-Mind Occasionalism? 1.1. Daniel Garber's Case for Descartes' Move Toward Body-Mind Occasionalism Occasionalism, roughly defined, is a doctrine according to which God's will is the only genuine efficient or productive cause that exists, and all other so-called 'causes' are really just 'occasions' for the exercise of that will.5 As Daniel Garber understands the term in "Descartes and Occasionalism," an occasional cause is "a cause whose effect is produced through the activity of God," and not through the exercise of any causal power within finite things.6 Body-mind occasionalism is a logical inevitability in Descartes' philosophy, Garber claims, because for Descartes "God is responsible for all motion in the inanimate world."7 The idea is that because there is no causal action on the part of bodies, bodies cannot act causally on anything, let alone minds.8Because for Garber body-body occasionalism is "as clear as anything" in Descartes' philosophy, he sets out to find evidence in Descartes' writings for [End Page 504] the body-mind occasionalism which it implies. It is Garber's case for body-mind occasionalism that I contest below, where I argue that Descartes remains a body-mind interactionist throughout his life. Clearly, my assessment of Descartes puts me at odds with Garber's more general view that Descartes is a body-body occasionalist, at least on the assumption that Descartes has a logically consistent position on body-body and body-mind causation. For, to reiterate Garber's point, to be logically consistent overall Descartes cannot be both a body-body occasionalist and a body-mind interactionist. Of course, Garber and I need not be at odds on body-body occasionalism; for since we need not assume that Descartes is logically consistent, he and I could say that Descartes as a matter of historical fact holds both positions. While indeterminacy is a recurrent theme in philosophy, less progress has been made in clarifying its significance for various philosophical and interdisciplinary contexts. This collection brings together early-career and well-known philosophers--including Graham Priest, Trish Glazebrook, Steven Crowell, Robert Neville, Todd May, and William Desmond--to explore indeterminacy in greater detail. The volume is unique in that its essays demonstrate the positive significance of indeterminacy, insofar as indeterminacy opens up new fields of discourse and illuminates neglected aspects of various concepts and (...) phenomena.
